The final rule of designation was made by the National Oceanic and Atmospheric Administration, National Marine Fisheries Service in 1993. Please refer to the Federal Register Notice titled "Designated Critical Habitat; Stellar Sea Lion" (Vol. 58, No. 165, Aug. 27,1993, 50 CFR Part 226) for details and the legal definition.These data are intended to represent the areas designated as Critical Habitat for Stellar Sea Lions in California by delineating a 3,000 foot buffer around the 3 islands or rocks where the specfied rookeries are located. The Federal Register Notice of August 27, 1993 gives the final rule for "Designated Critical Habitat; Steller Sea Lion";. For California it calls out one location offshore Humboldt County (Sugarloaf Island and Cape Mendocino); one offshore San Francisco County (Southeast Farallon Island); and one offshore San Mateo County (Año Nuevo Island). In California, major Steller sea lion rookeries and associated air and aquatic zones are designated as critical habitat. Critical habitat includes an air zone extending 3,000 feet (0.9 km) above rookery areas historically occupied by sea lions. Critical habitat also includes an aquatic zone extending 3,000 feet (0.9 km) seaward from the baseline or basepoint of each major rookery indicated in Table 1 in Part 226 of the Federal Register Notice. However, the coordinates did not match up accurately with the California Islands data delineations (NOAA Electronic Navigation Charts (ENC)) for those named sites. The NOAA ENC's are compiled from the NOAA paper Navigation Charts with updates from the Army Corps of Engineers and the U.S. Coast Guard. This data is more accurate than the geographic coordinates provided in the Federal Register Notice. Since the latitude / longitude basepoints given did not correspond to the islands data, the 3,000 foot aquatic zone was delineated by creating a buffer from the shoreline of the islands rather than the basepoint.April 2009
